Construction Law

Construction disputes are often time consuming, expensive, and can lead to costly delays in project completion. Our mediators have significant experience navigating the diverse conflicts encountered on construction projects, and are well equipped to assist in an expedited resolution.

Contract interpretation.

Breach of contract is a common legal theory under which construction disputes are regularly adjudicated. The interpretation of contracts among multiple parties can be complicated and require a detailed assessment of disputed issues. Several mediators on the LIMS panel have spent decades addressing the complexities traditionally associated with construction related disputes and are well prepared to assist parties in addressing remedies.

Insurance disputes.

A majority of construction related disputes are directly impacted by the availability of insurance coverage, risk transfer, and the interrelationship between the contractual rights of owners, contractors, subcontractors and design professionals. The nuances involving insurance among project participants typically creates another layer of conflict that requires considerable attention to address resolution options. Navigating the multi-layered issues and ensuring that the appropriate parties are represented at the negotiating table is essential to maximizing the chances of achieving a settlement.

Construction defects.

Claims involving construction defects refer to a deficiency in the construction process.  These claims generally relate to a failure in some aspect of a structure being built, leading to damages to property or claims involving personal injuries. These disputes invariably lead to finger pointing among the project participants who seek to deflect responsibility to others. Often times the path to resolution requires a thoughtful analysis of the roles of each of the parties to assess the appropriate value of a claim and distribution of responsibility.

Professional liability.

Professional liability includes malpractice, errors and omissions, and other design defects that can delay or damage a construction project. (See more about Professional Liablity here).
